Described in the schedule hereto as the Provider and the purchaser of the website, known as the Member.
Whereby it is agreed as follows:
The facility supplied by the Provider, consists of a 15 Mb. web site. This includes access (via username and password) to a back office area, which contains an easy to use web page builder. There is no limit to the number of pages the Member can create. The Member’s web space is controlled by the 15 Mb. capacity.
The Member can change their web pages any time, 24 hours per day, 7 days per week.
The Member can use backgrounds and images as provided, or upload their own from their own computers.
The Member can change their contact details, picture and message on their front web page (known as Member Page) any time, 24 hours per day, 7 days per week.
The Member’s website URL (address) will be www.elinque.com/theirusername. The Member has the choice of username at the time of registration, but cannot choose a username that has already been taken.
The Member will not have their own specific domain name.
If the Member wants their own specific domain name, see website for details, or contact our office. This personal domain name will be at the cost of the Member.
A fee of AUD$99.00 (including GST) is payable, on or before the anniversary of purchasing your 15 Meg Web Site. For those web sites paid for by credit card, the renewal fee will be automatically charged to the same credit card that was used for the original hosting fee. Approximately one(1) month prior thereto, the Provider will send the Member a notice advising the Member of this action. If the Member does not wish to renew, the Member must advise the Provider in writing, quoting username, prior to renewal date. If the Member wishes to use a different credit card or payment method, the Member must advise the Provider on a timely basis. If the annual hosting renewal fee is not paid, the Provider has the right to remove the 15Meg Web Site from its server.
A Member can use his/her web site for business or non-business purposes. However, a Member may not post, transmit or market any of the following:
* Any material that is abusive, threatening, defamatory, obscene, or otherwise unlawful;
* Any material that violates the copyrights, trademarks, service marks, trade secrets, patents or other property rights of others;
* Any pornographic, sexually explicit material or links to similar adult content;
* Any material that discloses personal private matters about any person without consent;
* Any material posted anonymously or under a false name.
eLinque cannot and does not screen all content provided on Member sites and does not assume any obligation to monitor content. However, the Member agrees that eLinque reserves the right at its sole discretion to remove any site, without notice and with no obligation to refund fees paid, which in its judgment is in violation of these Terms and Conditions or otherwise is unlawful or harmful to eLinque and/or its Members.
Any person or persons, who send unsolicited email for mass marketing will have their web site removed from our server.
In no event shall the Provider be liable for any claims or damages of any kind arising from the contents of a Member’s Web Site. Any references in a Member’s site to products, services, processes hypertext links to third parties or otherwise do not constitute or imply an endorsement or recommendation by the Provider. All product and service information is the sole responsibility of each individual site owner/user. Members are solely responsible for compliance with laws governing the offering, sale, licensing, or marketing and taxation of any products.
At times, eLinque will undergo maintenance or experience technical problems. eLinque will make every effort to do maintenance as quickly as possible. The provider will not in any circumstance be responsible for problems, losses, or damages arising from loss of connectivity; errors in content due to application problems; loss of access by Members; or temporary or permanent loss of data.
A Member indemnifies and holds eLinque, the Provider harmless against all claims made by any third party, and related damages and expenses arising out of or connected with the Member’s conduct, his/her web site or online store, the goods or services the Member offers, or any violation of these Terms and Conditions.
I understand that should I desire to terminate this agreement within 14days of registering as a Member I will receive a full refund.
I, the applicant, hereby apply to become a Member of Our ELINQUE, subject to the Terms and Conditions of this agreement, and certify that I have read and fully understand all the provisions as detailed in this Member’s Agreement.
